Overview

Welcome to SongMade4You. The terms "we", "us" and "our" refer to SongMade4You. SongMade4You operates this website, including all related information, content, features, tools, products and services (the "Services"), to provide you, the customer, with custom songs and related offerings.

These Terms of Service, together with our Privacy Policy and Refund Policy, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

By using the Services, you represent that you are at least the age of majority in your province or country of residence (18 in most Canadian provinces, 19 in others), or that you have the consent of a parent or legal guardian. You agree to provide accurate, current, and complete information when placing an order, and to update it as needed.

2. Our Products

We create custom, original songs based on the information you provide. While we aim to deliver something deeply meaningful, the final result is a creative work and emotional responses can vary. We do not warrant that the appearance, quality, or emotional impact of any song will exactly match your expectations. All product descriptions are subject to change without notice. We reserve the right to modify or discontinue any product, or limit quantities, on a case-by-case basis.

3. Orders

When you place an order, you are making an offer to purchase. SongMade4You reserves the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance and payment is processed. Please review your order carefully before submitting — once we begin work on your custom song, cancellation may not be possible (see our Refund Policy for details). You represent that your purchases are for personal, non-commercial use only.

4. Prices and Billing

Prices are listed in U.S. dollars unless otherwise stated, and are subject to change without notice. The price you pay will be the price displayed at the time of checkout. Posted prices do not include applicable taxes (including Canadian GST/HST/PST/QST), which will be added where required by law.

You represent that the payment information you provide is accurate, that you are authorized to use the payment method, and that you will pay all charges incurred at the posted prices.

5. Delivery

We deliver your custom song by sending a private gift link to the email address you provide. Delivery is complete when this link is sent, whether or not you open the email or click the link. It is your responsibility to provide an accurate, accessible email address and to check spam or junk folders if you do not see your delivery. Delivery times (typically 3 business days) are estimates only and not guaranteed; we are not responsible for delays caused by events outside our control.

While we host your gift link indefinitely under normal circumstances, we do not promise permanent hosting, archival, or re-delivery. We recommend you download a copy of your song for your personal records once delivered.

6. Intellectual Property

All content on the Services — including trademarks, logos, text, images, graphics, audio, video, and the design and arrangement thereof — is owned by SongMade4You or its licensors and is protected by Canadian and international copyright laws.

When you receive a custom song from us, you receive a personal-use license: you may listen to it, share the gift link with the recipient, and play it at private events (birthday parties, anniversaries, weddings, etc.). You may NOT use the song commercially, sell it, sync it to videos for commercial use, upload it to streaming platforms (Spotify, Apple Music, etc.) under your name, or claim authorship of it.

By submitting your story, memories, names, and other content to us, you grant SongMade4You a worldwide, non-exclusive, royalty-free license to use that content to produce your song. You also grant us permission to use anonymized excerpts, song clips, or testimonials for marketing purposes — but we will never publish your full song or identifying details without your explicit consent. You represent that you have the right to provide any names, likenesses, or personal details you submit, including consent from any third parties mentioned (such as the song's recipient).

7. Prohibited Uses

You may not use the Services for any unlawful purpose, to harass or harm others, to infringe intellectual property, to transmit viruses or malicious code, or to misrepresent your identity. You may not use the Services to create songs containing hateful, defamatory, sexually explicit, or otherwise objectionable content directed at any individual or group. We reserve the right to refuse or cancel any order that violates these standards, and to suspend or terminate access to the Services at our discretion.

8. Refunds and Cancellations

SongMade4You offers a 100% satisfaction guarantee. If you are not happy with your custom song, you may request a full refund within 14 days of delivery. Please see our Refund Policy for full details.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Third-Party Services

The Services rely on third-party providers (including Stripe for payments, Resend for email, Supabase for hosting, and Vercel for deployment). These providers have their own terms and privacy practices. We are not responsible for third-party services and recommend you review their policies if you have concerns.

11. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Some jurisdictions do not allow such disclaimers; in those jurisdictions, this section applies to the maximum extent permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONGMADE4YOU IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO YOUR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. WE MAY, AT OUR OPTION, RE-DELIVER YOUR SONG OR REFUND YOUR PAYMENT AS YOUR EXCLUSIVE REMEDY.

13. Indemnification

You agree to indemnify and hold harmless SongMade4You and our affiliates from any claims, damages, or expenses arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights (including providing names or details of others without their consent).

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and the province in which SongMade4You is based, without regard to conflict-of-laws rules. Any dispute arising out of these Terms will be resolved in the courts of that province, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to waive any right to participate in class actions where permitted by law.

15. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with a "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
